Hi guys!! Has evilbay ever sided with a seller automatically and just never even heard your side of the story!! This is what happened: I bid on an auction , I won the auction , I sent payment (money order) , I tried to contact seller but he never got back to me , I opened a case with evilbay , evilbay says wait for seller to contact you ,, HE NEVER DOES and EVILBAY say ,"WE SIDED WITH SELLER FOR NONPAYMENT"!! What acrock!! They never even asked for evidence like receipt of money order?? Now evilbay has not even responded back on this!! I just dont get it!!

Wow .... some where eBay's phone number is listed .. I would call and start complaining .. it's just the principle of the matter ya know ?

Thanks CHUCK!! You are the man!! Will contact tomorrow!! remember you get more done with sugar than salt .. I didn't call either number so i can't verify they are legit. Be calm and organized when you call.. Have the user's name, item number, M.O. receipt and dates .. also any correspondence you sent (even if you did not receive a reply) .. there is an 800 number on the back of your M.O. which you can call 24/7 to check and see if it's been cashed.. good luck .. !

Here is what I'll tell you. You should ALWAYS follow the guide lines for a case on eBay. It's best to know how to even if you don't have to because when it comes time you feel like you are getting the short end of the stick. From your description I don't know why they'd side with anyone because it doesn't sound complete. I had an issue 3 weeks ago and here is how I handled it. I bought a lot of kits off eBay. It was a BIN or Best Offer. I offered an amount and the dealer accepted it almost within an hour or so. I paid for it through Paypal. It stated in the auction that they'd ship within 2 days of payment. Towards the end of the week I sent a message to the seller merely asking if they sent it and nothing more. 2 days after I sent the message I got a message from the seller stating they had sent it on the monday of that week but they didn't have a tracking number on the insurance they put on it and if I didn't receive it Monday that I should contact them and they would check things out at the PO. I sent a quick reply asking for the insurance number they stated they put on it. I got no reply. I ask for the insurance number because it can be tracked as well. So I didn't hear anything for about a week after that and decided to try again on the request. Once again, no replies for a couple days. It's almost 2 weeks at this point and every message I sent was through eBay so it's documented. I decided to just open a case and did so but I put that I'd still like to have the item. When I got up the next morning to see if I got any messages in return I woke up to find that the item had been reposted. So at this point I figured I wasn't going to get the item nor did I want it because if the seller is going to do something like this, I probably wasn't going to get the item in any kind of shape that I expected it. I went to the case only to find out that nothing could be changed. I did see that the contact for eBay was a phone number. It stated that opperating hours were between 5am and 9pm PST. So at 8am EST I called the number. Suprisingly I got an answer within the first couple rings and actually talked to somebody that was really easy to understand and was understanding of the situation as well. I told him everything I knew again even though he could see it in the case and I told him that I didn't want the item at this point, I wanted my money back. He understood and documented it. This morning I got my refund and it was Friday that I talked to him. There is a 7 day protocol for the other party to respond before the money can be refunded. This scenerio doesn't work for you entirely though because I'm not sure what kind of protection you have as a buyer with using a money order rather than Paypal but talking to somebody versus trying to handle everything through the net is a huge difference. So the main things are, always send messages through eBay, keep your receipts if you are going to use an MO. I'd use a postal money order because they can be tracked and checked at the post office. If they cash it and don't send your item, it's fraud. So if you filed a Case, go to the case and find the number, there is a key that you will punch into the phone that will get you through to an operator that will help you with the problem. AJ, How bout a verbal kick in the teeth! Check the feedback my friend... 24 negatives in 6 months! Mostly paid, but did not receive! I wouldn't buy a stick of gum from a bayer with that record!

Yeah, that was a lapse in my usual look at things. I never noticed the percentage and didn't look at their feeback. Looks like somebody bit again though. I just hope somebody gets the lot, it looked like a fun one.

Well I got one for you then. I bought a lot of CB/Ham mics from a guy on ebay. He sent half of what he listed. I asked him about it and he said he could get more money for the stuff then what I paid and wanted me to send them back ASAP. He gave me an address in eBay messaging system. I opened a case as you dont get their info and I wanted to make sure it went to the right place for a legit refund. eBay sided with me on the case (one of the very few I have to ever open) and gave me a free return shipping label. I printed it out to put on the box and just out of curiosity checked the addy he gave me. He gave me an address in Kentucky and eBay has him down for West Virginia. You know I sent it to WV. I had to call eBay on this case and they are easy to talk to. Always willing to help a buyer. Do call. But buying with a money order is a tough one. Sellers are only aloud to take Pay Pal or credit cards. A lot take money orders still also but it is against eBay policy to do so and they wont put it in the listing as such due to the listing violation. Good luck. I just hope you have an email (with full header) or eBay message stating he took money orders. Let us know how it goes. There is also a number I use, 1-866-877-3229.... Not sure if there is an area for each number but worth a shot.

I also strongly suspect that eBay rejected the claim due to the payment being MO (not Paypal). Ebay owns Paypal and can easily track Paypal transactions. I exclusively use Paypal for eBay payments and when I opened few cases on non-received items, eBay always refunded my money.
I suspect that since they officially do not support MO as payment methods (only Paypal and credit cards when taken directly by the sellers), they won't be bothered to refund MO payments.
In that case you need to deal with it through USPS as mail fraud.
I've been using Paypal since 1999 (and also had Billpoint account - remember that?) and I never had any problems which weren't resolved. Well, I did once but that was because I waited with filling a claim for over 30 days hoping for the seller to come through. He never did and was unregistered from eBay.

Is there any way to stop payment on the MO? Was it a USPS MO? If you have the receipt there should be something you can do.
